Leasehold- wrongly informed

We brought our property in June 2007 which we were informed by the estate agents that the lease was 90+ years I think it was 92 years need to check this. We had lots of difficulty moving into our flat. However after we moved and were in our property we recieved a contract for our lease which states we had 83 years, so now it is 81 years. Our landlord wants £7000 to renew this now!

It there any come back on the solictors. On all out mortgage paperwork is states there is 90+ years on the mortgage so I'm guessing the mortgage company would have obtained this information from the solicitors. If we knew the lease was this lower we would have offered less or not brought it at all.

Any help would be much appreciated

Did you take this up with your solicitors and Estate Agent at the time. I think having left it two years may make things more difficult.

If you have a solid paperwork trail, confront your solicitors with it, as it would appear that the solicitors have not done their job properly in checking out the contract and protecting your interests. Surely that is what they are being paid for.

It would be fair for them to pay for this to be put right, however fair and the law do not always meet. You may need alternative legal advice to see what your options are.

    Good Luck

I would have thought the solicitors would have told you this before you purchased. Check the documentation the solicitor gave you back then.

  • You would have needed to sign a lease at the time of purchase, and the length of that lease (for me, at least) is on the title deeds - I'd check both of these to see what your solicitor told you at the time.
