CCJ looking likely...facts??

Hi, I posted a few days ago as Natwest causing problems. I've been in a DMP with CCCS since November last year and hadn't heard anything from them until March this year and although kept referring them to the CCCS they kept ignoring me. They put things in the hands of Shakespeare Putsman who have rejected the payments already being made (£192/month) as it would take 7 years to pay off.

I'm a bit naive with court actions but have a couple of questions. If the court decide they are getting paid a fair amount will this still go to a judgement? Are they doing this to get a charge on the house (have about 30k equity depending on the present house market) and if so can they do anything about it as we have children? I've decided to play a bit if hardball and am sending them a subject access letter to see if I can get bank charges back but does that put their request into dispute and how does that effect the whole court proceedings?

I'm not overly concerned about my credit rating as it's probably shot to pieces anyway but I find the thought of a CCJ as a real stigma. They have been really difficult to deal and although I'd much rather be in a position to pay everyone back from what I understand they shouldn't get preferential treatment over my other creditors so are they just making sure they can take things further if for any reason I can't make the payments (hopefully that shouldn't happen)?

I's appreciate it if someone could give me the benefit of their knowledge through this minefield, thanks

    What sort of account is this, loan or bank account?

    Do you have the default notice and termination letter?

  • Hi, the accounts are for a joint current account and a loan. I've got default notices for both. They haven't gone the legal route with my husband yet for the joint account and not sure what they are going to do with that.
  • Should say they are both unsecured

    When did you take the loan out?

    With respect to both accounts, can you scan the default letters, having removed all personal ids, barcodes etc and then put a link up to them? You may have to do a few more posts first.

  • Hi, the loan was taken out in 2006 and so far paid off 5000 from a 17k loan that was supposed to last for 7 years. I've scanned the termination letters, where should I put them for viewing? Thanks for your time
