Mortgage early repayment fee

Hi
i have had my house up for sale for 2yrs and have just recieved my first offer at 170. The house belongs to me and my ex husband and needs to be sold as me nor my ex can afford to pay mortgage.
H e told the mortgage company northern rock that we had an offer, the mortgage is 167 but with the early repayment fee it is 175 in total they want back. My ex has asked them if they would waive the ERF and they have refused, and they said they need us to fill in our income and out goings before they agree to the sale.
I have spoken to them today and explained that we need the house to go through or it will mean my ex delcaring bankrupt and then will force me into doing the same because i am unable to pay the mortgage either. If they do agree the house sale they still want the rest of the ERF which we will have to pay monthly. which i cant afford either.
Does anyone know where i can go for help and if i can speak to anyone that could get this price reduced. i am worried cos i already have a large debt without the mortgage and the estate agent fee really could do without having to pay an extra 5 grand.

  • Unfortunately as you signed an agreement to pay the ERC (as part of the mortgage offer), it's legally allowable. How long before you're out of the ERC period? Any chance you can hold on until then?

  • Unfortunitly cant afford to stay here any longer and my ex cant afford the mortgage so im stuck really. The fee runs out end of 2011.
  • Are you going to buy another house? If so, you could transfer the Northern Rock mortgage to the new property. If the mortgage you need on the new property is smaller, you will only pay the ERC on the reduced amount.
