sacked and benefits

My dh has been sacked after 5 years good service he had a mental breakdown at work and assaulted two colleagues. Am not excusing his behaviour in any way and this is very much out of character.

He is trying desperately to get a job with an employment agency and fingers crossed hes successful However if he isn't will we as family me, dh and 2 kids be entitled to claim any benefits. We have no savings and literally if he doesn't get a job with one of these three agencies we are up the creek without a paddle.

any advice greatly appreciated

    He can and should make a claim for JSA but there will be implications as he has committed an act of gross misconduct I'm fairly certain he will have it sanctioned but that is not something I would be sure of as it is down to a Decision Maker. Unless his mental state has already been acknowledged by his employer, I doubt is can be used to mitagate his actions after the event but nevertheless, he should be talking to someone professional about his frame of mind as being unemployed isn't going to help him feel any better.

    As he has a family to support, the DWP should advise him which benefits he and you should be able to claim - i.e. Income Support, Housing and Council Tax Benefits, Child Tax Credits and so on. If Citizen Advice is too busy, try your Council's Welfare Advisor.

Unless his mental state has already been acknowledged by his employer, I doubt is can be used to mitagate his actions after the event but nevertheless, he should be talking to someone professional about his frame of mind as being unemployed isn't going to help him feel any better.

They will not get IS, instead JSA, LHA and, CTC, CTB. This depends whether the op is working If Citizen Advice is too busy, try your Council's Welfare Advisor.

    He hasn't actullay been sacked yet. He has to attend a disciplinary hearing on monday but the letter heavily implied he'll be sacked for gross misconduct( not surprising). so we have just been desperately trying to get something, the employmeny agency he went to let him use a former work reference from his job before this one. so we are hopeful things should be ok. He is on anti depressants now and hopefully without the stress he was under at the last job he should be ok. Also waiting on a counselling appointmeny from gps.

    Thanks for the advise I was worried that if worst came to worst we wouldn't get any help as technically he put himself out of work even though he wasn't in his right mind so to speak at the time.
  • sorry forget to add, there won't be any charges, the police were called and because of the state my dh was in they talked the two people out of pressing charges so there is one good thing in this mess.

    If he could get a gp's letter which explains the reasons why he acted like he did the decision maker may take it into consideration. If he does get sanctioned you can claim for the hardship fund.
