Ex-girlfriend paying me her debt...
I suppose this is on-topic for in here,
Myself and my girlfriend broke up around a month ago, before then she wanted a laptop and couldnt get credit herself so we put it in my name and got it, she would be paying me back, since then we have obviously split and she still has the laptop and I do trust her to still make the payments to me athough she is a student and isnt that well off so may struggle from time to time, as you can imagine, myself being a student too, I cannot afford to be bailing her out so to speak for this as I've my own bills to worry about.
The worrying thing is if we fall out and she was not to pay to me, where do I stand? They would still be my goods at the end of the day? Basically I just want it finished with and to wipe my hands of the laptop.
Any advice?

Unfortunately it's your debt. If she stops paying you then there's not much you can do!.....0

Is the laptop in your name - Ask her either for the laptop or the money for it...
If she stopped paying then you could possibly claim theft although I'm not sure of the legal implications given you have effectively gifted it to her.0 -
The black & white answer is tell her you either want the money in full or the laptop back.
But...if you broke up with her then perhaps it would be a rubbish to demand anything. Perhaps suggest she increases the payments when she can.
Lesson learnt in future though hey? If she wanted the laptop that much she would have saved.0 -
When you say the laptop is in your name, what do you mean?
Was it registered in your name? Is the guarantee in your name? Or is it just the loan in your name?
Either way, it is may be immaterial - she has possession of it, so the question then arises, was this a gift, was it a loan of money to buy the laptop, or was it the loan of a laptop. Each scenario has a different outcome.
For the moment she is making the payments. You should get her to pay by traceable means - cheque or bank transfer - rather than cash, which will show that she has been repaying the loan, and support your argument that she owes you the money.
If you can get her to sign a piece of paper to say that she owes you the money, that would be really useful if she dafaults in future.
One way of doing it is to write to her and say 'Just confirming that you still owe me £400 for the laptop' when she actually owes you less than that. The likely result is that she will write back and say 'no, you are mistaken, I only owe you £300'
If she does that, you have proof that she accepts the loan.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
How much was the laptop? Is it worth the hassle of trying to formalise the deal when she is making repayments. There is no reason to think she will stop, is there?
When she makes a payment, give her a copy of the credit statement, Next time, don't be so daft.
