grrrr ex employer

I left my job in the second week of Jan this year...and still not had my p45 :mad: as you can imagine this is holding things up for me, I called them today and they said they were still "finalising my pay" ?????? what ever that means. I had my last pay and wage slip off them in Jan.


Does it usually take this long to sort out? or are they just being a pita. :rolleyes:

Is there someone that I can call to tell them about this eg the council?

    You should certainly have had your P45 by now. When I left my last employer I had my P45 within a couple of weeks of my final pay slip and wages!

    Is your ex employer a big company or just a small one off? You could always try phoning the Inland Revenue office that is on your payslips/records and see if they can do anything - other than that it is really upto the employer to have done it and they should have it done by now!

    The company is fairly small....I rang the Inland Revenue, told them the situation, they sugested gicen the company a few more weeks, if no joy by then ring the IR back again and then they can apply some pressure. Failing that a P46 should be on its way.

    Thats great, I would ask the company again - you will probably need it - have you started a new job? You will also get the P60 end of year certificate soon aswell saying how much you have earned etc in the past financial year.

    Assuming you are in new employment your new employer should give you a P46 to complete.
    Your new employer will in due course provide you with a P60 but this will only cover earning in their employment, without the P45 or notification from the IR they have no official way of knowing what you have earned in the past. As far as I know your last employer is under no obligation to send you a P60.
    Keep pestering your old employer for the P45 (but don't hold your breath, you might mention the P60), forget the IR getting you the info - it won't happen.

    The latest date for an employer to get a P60 to the employee is 31st May.

    I would of thought that if you have been employed by a business you will get a P60 from them. If you are an ex employee and you request a P60 they have to give you one if you have received pay from them!

    Yes I agree HJB latest date is 31st May, but in practice that doesn't always happen.

    Every company I have ever worked for (large & small) the P60 for any employee no longer working for them (providing they left before tax year end) was never sent to the employee. The P60 you receive from the employer you worked for at the year end would show "earnings and tax deducted" in previous employment, so this would just be duplicating the information.

    I didn't think that an employer was obliged to send a P60 to those who left their employment during the course of the tax year, and I used to run payroll. After all, how am I supposed to keep tabs on where they're all living now?

    But I will check at work: the P60s have come in from our payroll people and I will see if they have prepared them for any of my former colleagues!

    Also HMRC WILL pester a previous employer for the P45. They certainly used to chase me up - and half the time I didn't know the person wasn't coming back! (students, casual employment!)

    Savvy_Sue - worked directly & indirectly with payrolls for 40 years & never got asked by IR for a P45, must have done everything right (I don't think) or more likely we had an IR office who could not care (I can upset them now without worrying about an audit).

    Of course all this does not help Mboro get his P45. Being in a new tax year and with all the year end tax returns falling due, might just persuade his previous employer to do something. Me, I'm still not optimistic that he will ever get the P45.

    Maybe it does vary. And maybe because there was a large student population in my IR area they often found people starting new jobs without giving in a P45 and tried to get P45s out of us.

    It was never my fault someone didn't get a P45 - if they told me they didn't want to work for me any more I always did send them one! But often the first I knew was that letter from the IR! :rotfl:

    Very grateful to you for clearing up that P60 question. Had forgotten to look at work, but DH was asking it as well as his payroll people gave him one for someone who no longer works for them, who he knew had moved house! I did tell him he didn't have to pass it on - employers can't keep tabs on their ex-employees! :confused:
