working notice period

hi,

if i was to be offered a job with a company who wanted me to start in a weeks time but the company i currently work for wanted a months notice what are the consequences of leaving after the one week ?

is it likely just to be the loss of a good reference

i have been there under a year though i don't suppose that is relevant

    Unless your contract says you have to give one month's notice then only a week is required.

    If you just walk out they could, in theory, sue you for any losses they suffer as a result. e.g. the extra cost of sub contracting your work perhaps. I don't think this happens often but it could....

    Are you owed any holiday? Probably best to negotiate something.

    They could withold pay if it is a contractual term.

    Personally it is just common politeness not to leave them in the crap. I dont think it is very good that new employers expect people not to give the required notice as I am sure they would not appreciate it.

    Didn't you tell them when you applied/went for the interview you had to give a months notice? Most places understand that people have to give notice, this is why they ask.

    Your current employer could potentially sue you for breach of contract but it's unlikely. A quiet word explaining the situation, giving them as much notice as you possibly can would probably be enough.

    ETA - check your contract if you have one. Although you don't really need a written contract, if you and your employer have verbally agreed to one months notice, then that is a contractual agreement. Also check about witholding pay if you leave early but I don't actually think they are allowed to do that.

    i'm due 18 days holiday before the end of the year but i reckon i can't expect to use my full years entitlement as early as july to replace notice,

    does that sound right ?

    Have you been offered the job in fact?. If it is that you are going for another job you need to tell them that you are required to give a months notice.

    will starting a new job within ten days of being offered it mean that i will definitely not get a reference ?

    will that probably be the worst consequence of leaving early ?

    It depends on the employer. And how honest and considerate you are to them. I'm sure if you explain the situation to them, and give them as much notice as possible, they may understand.

    If you just leave and don't tell them, I can't see them being too happy with you!

    I have accepted the job on offer and have decided to work two weeks notice.
    It appears that i will lose a days pay for every day of the months notice not worked.

    That seems a bit mean but i guess there is not much i can do about it apart from working the full month

    or is there ?

    Sorry but am I being thick - if you are losing a days pay for every day you don't work....doesn't that mean you are getting a days pay for every day you do work????
