Brothers debt killing our mum, please help

    At the risk of being very contentious and not arguing the rights or wrongs of the bailiffs, no-one seems to raising the issue of why this happened.

    OP's brother disappeared owing money.
    OP's brother has left his vulnerable mother to face the music.
    OP's brother is conspicuous by his absence while OP living abroad is trying to sort this remotely.

    I don't condone the Bailiffs actions but calling them every scum of the earth while completely ignoring the man who caused the chaos seems a tad one-sided.

    They can issue a warrant but they can hardly arrest your brother if he is not there.

    Have you spoken to Herbie21 as we advised, as she is more clued up on court enforcement then us? herbie21 will kick marston's into shape.

    Do you have a court details?

    Write a simple letter to them quoting the reference number and tell them that brother left 2 years ago and his wherabouts are unknown. Send a copy fot he lter to the DVLA at Cardiff as well.

    The police eh? What a superb idea. After all, they're the ones trespassing and attempting to extract money with menaces from an old women who isn't responsible for the debt.

    It's about what I'd expect from that lot if that is what you mean. Even in cases where an arrest warrant is possible (I honestly can't remember if it is for car tax but I didn't think so) issuing a warrant is a decision for the judge, not a bailiff.

    Well if you decide that's the easiest route to go due to her being anxious over this I don't blame you, but you certainly shouldn't have to do this. They shouldn't be harrassing your mother and its disgusting that they are choosing to do so.

  • hi again, A warrant can be ordered for car tax fines, it's a criminal offence not to pay car tax, same as Tv licence.The quickest way to sort this once and for all is to contact the courts. They are the only people that have the power to call the bailffs off.
    This is your brothers debt not your mums, the bailff shouldn't even be speaking to your mum about this, I would lodge a complaint with the court liaison officer. if the warrant is issued the bailiffs will go to your mums with police but as soon as they are satisfied that your brother isn't there they will leave.


    PS I do this stuff for a living so i know what I'm talking about.
