Is there anything they can do

I am sat wondering if there is any point in making a claim with the csa, My ex has been living and working in Nigeria for the last 18 months, he has his own business out there, i had never claimed before he went as he used to give something towards his child, not a fat lot i may add and quite sporadic but i really couldnt be bothered with the arguments. Since he went he has probably been back to see his child 3 times and has probably made as many payments, but is there anything they can do when hes self employed and in another country from what im reading they cant even seem to enforce self employed people in this country. My feeling is that its going to be a fruitless excercise does anyone have any experience of similar cicumstances?

    I may just give it a go, to be honest its the principle of the thing, im used to handling things on my own and seeing anything he has given in the past as a bonus as he hasnt ben very forthcoming in visitation or payments since my child was around 4 years old and he is now 8. He does however expect to be able to walk in and out of his life as and when he pleases :rolleyes:

  • I agree that it is worth a try. Get in touch with your local Magistrates Court that handles REMO and ask them to send you the information and forms to complete. I'd do it quickly as REMO can take some time.

    Yeah i have spoken to the CSA who gave a no hope in hell response that they could do anything about it, neither would they have told me about REMO unless i had asked them, I had to inform the man at REMO that they do infact cover Nigeria lol, he said hes not too sure how good they are over there at enforcing it but the Magistrates court should be my next stop, i will give it a go and see what happens.

    You need a court order first before you can use REMO.
  • CMAC - Remo told me the other countries court system would get a court order based on his earnings over there. Are you sure about needing a court order prior to going down REMO route?

    Now, I have a big question. What if the NRP works in another country, which has its headquarters there but has just acquired an additional studio in UK (the company has locations globally). He is not paid in the UK, but in the other country.

    Would that throw open any possibility of CSA taking up interest in the NRP once again?

    You need a court order first to enforce and yes it could come from the other country but its not REMOs job to get it.

    How to apply

    A UK resident who wishes to apply to obtain maintenance from a person overseas should approach:
    • their local magistrates' court (or county court where the order was made) if they have an existing court order for maintenance; or
    • their local magistrates' court if there is no existing order.
    If he is in the uk still push for a court order before he goes

    Thanks for that........I studied it over the weekend, and read exactly the same thing! I think the sticking point is that if I had a court order already, things would have moved quicker. Your suggestions have been helpful and I've acted on them already. Many thanks!
