CSA and Data Protection Act 1998

I posted this on the wrong forum before:

Parent with care has received a letter from the CSA with all of NRP financial details on. income, tax credits etc.

Is this not a breach of Data Protection Act 1998 by the CSA as she has also shown it to her husband and the letter is in her name only?

Her husband has commented in a very sarcastic way about the amount of wage NRP earns to NRP.

Also NRP signed a declaration years ago stating that he did not want address etc being disclosed to PWC.

Does anyone know if the CSA can do this?
Will his National insurance number bo on aswell?
Can PWC show others this?

It will only have his average net weekly income on it - so that it can be show how its worked out.

I've just dug my most recent notifications out, it tells me his net income, but not his national insurance number, or any other personal info.

I imagine PWC can show it to whoever she wants!

From my experience the assessable income will be information that all parties are privvy to, but if a form has been completed/signed regarding address information, this is usually 'marked out' on any relevant documents copied to PWC, as are details of any 3rd party etc etc. NI no may be on documents, but would assume that if you previous partners then most PWC would have this info anyway?

Is it linked to an appeal at all?

No there are no appeals...there was an adjustment as CSA had not included one of the relevent children for 3 years in previous assesments, even though the information of the birth was given to them on numerous occasions.
They had to inform PWC that there was to be a decrease in the arrears owed(which I might add were due to CSA telling us to pay the incorrect amount) also the weekly amount was being reduced due to the new assesment with the other relevent child finally being included.

INcome details are always divulged to the PWC because otherwise they would not be able to appeal if they think it is incorrect. What other details have been given regarding the NRP?

Kellogs36...Why do they not give OH the same information of PWC so he can appeal if he thinks her benefits are incorrect and working income?

What if they do not have income details? How can they convey these to the PWC?

If they don't have income details - or haven't even asked for them, in my experience, they think of a number double it, add some and then state this is NRP income.!!!!!!! Sorry just too many bad eperiences!!

Your right:rotfl:. They had my P45 details from 1997, which showed about £200 gross p/w, yet they put in a £106.00 weekly IMA?

Some of these guys were pretty clueless when it came to clerical work. I even notice a digit figure error from the DATA files, where the dot was in the wrong place.

Because the PWC income is not used in the assessment so it is totally irrelevant. Under CS1 the income IS divulged in the same way as the NRP's.
