LCS told me to wait until I complete before pursuing my claim, however the deadline to put in a claim is 6 months after WH stopped representing me i.e. the date of the SRA intervention.
Note: I was looking at the SRA website, and according to their code of conduct (Rule 2.01 SectionWH should have informed the client at the outset if they had the resources or skills to complete the work.
I don't doubt they had the skills, but they certainly lacked the resources to complete before the end of 2009, and based on what I've read on this thread they certainly knew they lacked the resources, therefore they must have been willingly neglecting the client.0 -
Do you know which firm of accountants prepared the accounts and SRA returns for Wolstenholmes. Did any of partners family members work at the practice apart from Mrs Ilyas?[/QUOTE

There is still a doubt that the SRA have failed to clarify 100% yet, different people told different things, as to whether the SRA or LCS will be paying for the new solicitor.
You will have to decide whether to register it yourself, for me it was best to use a solicitor.
You can make a claim now and one later.
You do not need to pay the Land Registry to see if the property has been registered to you, they are very helpful on the phone when you explain about WH and will tell you the state of play re. registration.
Although the SRA can make payments my understanding is that all the LCS can do is make awards against Wolstenholmes which their insurers may or may not pay out on. Can anyone out there correct me on this if I am wrong? I am sure Wolstenholmes will also have an excess on their indemnity insurance policy which presumably may also be a problem for anyone with a claim for less than their excess.0 -

The duty of the insurer is to pay out on the claim. Collecting the excess is between them and their insured.
My guess is that the insurers of WH are not happy people.0 -

Yes you are right! i have received a letter today from Gordons LLP (They are appointed by SRA to assist DWF) that they have found my file...

From a conversation I had yesterday with the LCS I am under the same impression about whether or not WH insurence will pay out. It did not feel very hopeful to me.0
