Cabot Financial and Unidebt Collections

Right, Cabot are really getting on my wick. I've written them 3 letters to which they've not responded. Well they have responded but they're being silly, saying it's my responsibility to know what's going on with my account. I've asked for a complete breakdown of payments made to them, all interest accrued, any charges made and so forth. I've read somewhere before that you can make a request for certain information from them and if they don't provide a response you can give them a damn good legal shooing. What is this for and what laws cover it please people?
I know I could make a DPA request also for the financial information that I want but as they're really annoying me I want to give them loads demands they must meet at the same time, so basically anything I can ask them to do that requires them to do it because they would be breaking the law otherwise would be good to know. I've read that you can demand a true signed copy of the credit agreement and so forth, it's things along these lines that I'm interested in.
Also I'm chasing down Unidebt Collections. I believe they owe me money in the form of unfair charges yet my letters are bouncing back. I have them at PO Box 470, Tweedale, TW3 4WN. Does anybody know any other different address for them at all?

cabot dealt with these little chaps some time ago they are quite mad if they phone you up just agree to what they want gets the muppetts of the phone, then send them what you intend to pay and pay it every month up it when you can afford it ,if they dont like it they can take you to court make same payment offer it will be accepted by the court dont enter in to agreements etc via phone its pointless after that ignore them0

That's what I've had to do, I'm paying them by S/O and now they're saying they do accept it, they don't accept it, they'll consider my review. It's like their system has gone skitty! I'm writing back enclosing 10 photocopied sheets of previous letters in the hope that someone who knows what to do with the system can figure it out and sort it.
I need to threaten some kind of legal action or legal responsibility on their part to make sure my request is dealt with my some more senior person0 -
Hi folks, I could really do with some help at the moment if anybody knows anything about DCA's and law. I've found this, is this true?I require you to supply the following documentation before I will correspond further on this matter. 1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxx. 2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists. 3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974. Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities. As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued. Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.
They are also refusing to amend my address details on their DB despite asking for it 3 times. I know it's my right under the Data Protection Act to ensure information about held about me is accurate and up to date. Is this totally applicable for DCA's too, can I make an official request in a letter asking them to update it? Would they require a payment for this also?

the letter is correct ,if dca and there incompetant staff do not ammend your address after you have told them then tough luck on them really keep a copy of the letter and make sure it was recorded that tells them of your change of address0

You can make a complaint to the Information Commissioner (responsible for data protection). Should make them move.

Thanks for the advice you guys. One of my main gripes still with Cabot is they are refusing to give me a breakdown of my account payments, interest, charges etc. How do force them to give this information over (any other way besides a DPA request and a £10 charge). Is there a law that deals specifically with DCA's that says that must give me an account history if requested. Maybe it's included in one of the Acts in my earlier post with regards to getting the signed credit agreement?

No. They are OBLIGED to carry the correct details. They're in the wrong, they have to sort it.0

Does the bit "your obligation also extends to providing a statement of account" mean they also have to give me the account breakdown of payments, interest, charges etc? This is the main thing I need TBH. Thanks for any help0
