CSA1 arrears

If a CSA1 case was closed with a view to reopen under CSA2, would the arrears for which a Charging Order is in place not be payable to the PWC?

just wondered, why would you want to close down case under csa1 to re-open under csa 2 when there is a charging order in place. wouldnt that just confuse the issue?0

Because I am getting nowhere with normal maintenance assessments under CSA1.
It may confuse it but not for me - if it's a confusing issue for the CSA then so be it.
But I need to make sure that the arrears would be payable or my other option is leaving all as and applying for a departure - am just musing my options.0 -

I'm not so sure the case can be closed with arrears outstanding, unless you are able to right them off, perhaps Kellogs can assist more so , good luck with the case.0 -
NACSA will be able to confirm, but as far as I'm aware, they CAN collect arrears due but they are reluctant to do so and will try to tell you that they can't do it. Push for the procedure in writing and then contact NACSA.0

Kelloggs (or CMAC), if the net weekly wage is £189 (no cash in hand going on there eh?:rolleyes:) and there is one dependant child in the household, what would be the protected earnings level for that amount?
No point me thinking this is a possibility if I'm going to come out at the same assesment figure.

Bad news for you all out there with arrears, after my little chat in the House of Commons, it was said that the political will has to be found to deal with this issue! They accept that it will be a bitter one but they are talk of writing them off. There are many reasons for this, but in a nutshell they are more worried about the level of debt in this country, the highst in the EU, and they dont want anymore 'Toxic Debt' laden banks to bail out, as I understand it they will be talking to Mr G and his not so merry men on the matter of enforcement as well, on not creating more debt to meet targets.
The Law changed on lending today as well so thing are moving on this front, the economy of the Country is more important than the CSA reaching its targets,and the Gov is now coming to that conclusion.

so any nrp that decides they are not going to pay, will accrue arrears knowing that they will be written off?? am i understanding you correctly. So basically pwc's dont stand a hope in hell!!!!0

No not all will be written off and it is only being talked about, the figure that was put out was about 60% as there are deamed to be uncollectable.
I would go further and say that it would be a very stupid NRP that took that line of thought.
In the amount that would be written off, and I am guessing here, would be the amounts that are owed by people that have died and the money is in probate and the like. They did not go into details, but they are looking into it that is for sure.
Enforcment in the "2" reay 'rule' guid will I am preety sure get the chop, but again only a guess from what was said.0 -
However one think that is as sure as I can be from what an MP said is that there has been a seed change in the thought process as the present system simply is not working! That is all 3 of them, I think that they will also be looking at legal aid ot what it is called and that will not be available in its present form.
The days of the profesional PWC may well be numbered as well.
My opinion is that teh pendulum has swug and is now on the return trip!0
