EMC advisory services: case closed?

I used EMC advisory services last year to follow up a shortfall claim. Whilst waiting for the endowment provider to respond, I received a letter from EMC claiming that they were closing the case unless I responded to the letter or contacted EMC within two weeks (neither of which I did). Over six weeks later, one of their agents contacted me, by which time an offer had been accepted from the provider. Now they claim that I need to pay their fee, even though they told me that they were closing the case last year! Can anyone tell me whether they are acting illegally by trying to claim a fee after they informed me that they were closing the case? What should I make of the fact that they told me they were closing the case but then kept it open?
