Under CSA1 the law reqiures you recieve a MEF at a compedent address (ie an address they known you live at or that of a member of your family or friend would past the MEF on to you) If you can prove that this was not the case then the CSA have no Jurisdiction to carryout an assesment.

You simply need to write to the CSA and request a change of circumstance that they closure your case from the original effective date base upon grounds of jurisdiction. If they say no than take it to appeal

please do not take this as a wind up. My partner was sed by the HO to be here illegally even tho he was given an NI number in 1993 and been working payin tax and NI ever since for the council. The HO decided it was a mistake he shud have never been givin an NI number. We have been thru hell with the HO, at the time it was choice to either fight to keep my partner and father to my 2 beautiful girls in the country or fight the CSA. We didi not have the strength to do both. He jus got his payslip one day with it saying CSA £300 didint even know wot it was!. So as for that that is the reason! he lost his job he lost everything after working for the same council for 16 yrs so please give us a bit of leanienecy on this.

CMEC you seem to be knowledgable on this. How do we go about this do we need a solicitor???? im fed up fighting the governemnt first the Home Office now the CSA next its inland revenue cause he been on wrong tax code for 10 yrs!! i know he is in a mess but we trying to sort it out, maybe too late but we are trying. From that logic the csa can take money from anyone for anything :eek:, that doesn't make sense even if the organisation is run poorly, as suggested elsewhere contact the independent arbitrators.
