The company i worked for was taken over in feb 09. I cant get a p60 from them or the new company as both companies are denying liabilty for it. I have spoken to tax office who say it is my new company that owe it to me and to speak to them. What is the worst thing is my tax code was wrong ALL last year and the tax office estimate i am owed nearly £1500 but cannot process this until they have a copy of my p60. I really need the money but i am getting no where. This is exasperated by the fact the new company dont pay me the correct moeny and i have to chase it every week. They operate on a basis where you have to fiull out a complaint form and wait 5 days to be resolved/..... main issue my p60...can anyone help or advise

Who was paying you at 5th April 2009? Whoever that was owes you the P60.
I would have thought that as the deadline for submitting the information to HMRC - and by the way,handing the P60s to employees, has passed, it would be realtively easy to work out who could give you this information2014 Target;

It's the new company's responsibility - maybe you should remind them that you should have had it by 31 May. Have you asked HMRC whether they have received their return from the company yet?£705,000 raised by client groups in the past 18 mths :beer:0

Definately agree with "mountain" - it is the new companies repsonsibilty as they would have taken your pay to date forward from February and issuing of P60's is after the 5th of April.
Given the issues with both obtaining info and your current payroll, I would take the view that this company do not know what they are doing.
I would write to HR outlining that they are legally reponsible (as they held your contract after February) and you are legally entiltled to your P60, failure to provide it witin 7 days - you will refer the matter to the HMRC for further investigation - see where that gets you!
As mentioned in previous post, I would also query with the HMRC on whether they have received your returns from your company, I would guess they may have something seen as they were able to tell you that your tax banding is wrong over the phone - may be prudent to suggest that you have doubts in your companies pay system!! ;-)0 -
I remember asking HMRC about when a P60 should be issued by, and they said it must be issued no later than the 31st May.
OP, this means that both companies in your case are breaking the HMRC rules (not sure if it's law, though), so it's in their best interest to sort it out, unless they want the tax office on their case.0 -
Have you made it clear to the tax office that the new company is actually refusing to provide you with one? I would make sure they understand this, it might not have clicked during your chat.0
