Please Help :(

Hi guys and gals, Im not 100% Sure if this is in the right place, Sorry if not

However, im after some advice, Im having some trouble with my car finiance at the moment, so to try and sort out all my finances, ive got all of my paper work together and ive found my car finnace contract, Witch i signed in the march of 2007, HOWEVER, it seems now, Ive been made reduntent, And cant find work for the life of me, Ive got behind on payments and there threatning me with reposession, so i asked for a copy of my contract, because the sums and figures they were throwing about just didnt add up. It turns out that the car was re-financed in september 08, I havent signed a new contract nor did i agree to this.

Im pretty sure thats not right, lol, And im not sure if i should seek legal advice before going gung ho on the phone to them?

i have no idea about these things, But id assume, That they have cancled the previuos contract, Witch i agreed and signed for 2 years back, And they off of there own back Re-financed the car in september 08, Witch i DID NOT agree or sign for, Surley that would make the contract void?

im under an amazing amount of pressure at the moment, As im sure many people are in these hard times, and this really does not make it very easy..

Any advice would be great

Nick - how do you know the car was refinanced in Sept 08? Do you have a letter from them advising you of this? Did it change the amounts and lenght of the finance?

If you are struggling to pay - have yuo checked if you can hand the car back? Often if you have paid more than 50% of the payments there is an option to hand the car back.

If, in the unlikely event that this contract is not legal, you will have to give the car back so not sure what your end goal is here?

I have the contract they sent, They extended the contract to SEVEN years, When it was orignaly only 4, So in theroy you would guess the contract was half way through in march 09, i cant see how they have any right in Re-financing my car, With out my knowledge, And extending the length, it may now be the case that i COULD have paid half if i was on the original contract, But now its extended to 7 years, Im going to be no where near half..... I have no problem what so ever in handing the car back, As long as i have nothing to pay, But i feel ive been cheated and been paying for somthing i didnt agree to.....

If i was able to hand it back, SURLEY id be able to claim the extra £ i have paid ...?

When they sent you the contract did they ask you to return a signed copy? Is there anywhere for you to sign?

It seems strange they would just send it to you without contact...If that is the case then you may have a case.

Did you just receive the "new" contract?
