Llyods tsb select account help

hi wonder if you can help im helping someone out who has had a "select account" from llyods tsb for 7 years i believe. Apparently this offers things like car breakdown cover, mobile phone insurance etc. problem is he has never owned a car or a mobile and had a stroke in 2003. He has no relocation of taking this out at all.

I wrote to lylods asking them to refund the charges in full unless they can prove he take it out - they admitted that due to the passage of time they do not have the paperwork and offered as a goodwill £173.

am i right in saying they must be able to prove he took it out? and could he claim under the direct debit scheme and get the money back that way??

I think he is entitled to all the money back? is there some banking law that would agree?
