How much was the SD for Pam?
Unless it was for a significant amount, or you have significant assets, there would be little point in them trying to make you bankrupt, when it would be easier & cheaper (and more appropriate) to get a CCJ.
I suspect this is a scare tactic, and would be really surprised if a petition was actually presented. I believe there are an increasing number of judges who take a dim view of the bankruptcy process being used as a credit control tool.BSC 2710 -
ther is some people on this board who will be able to help you and more knowledgeable than me ! however i do agree that soem company use statutory demadn as a scare tactic you should always try to put aside just in case ....
first who serve you the demand ? how was it serve (sometimes the demand wasn't serve properly which csan be a ground for setting it aside) ? for how much ? and do you have a contract specifying with the tenant saying it was responsible for the electric bill ? when is the last payment made on the debt ( might be statute barred) ? did you receive a default notice or some sort of acknowldegement of the debt before hand ? has it been passed onto a DCA ?
if you want some advise you can get some free, non judgemental with the national debtline .. they are good .BSC number 1830 -
