EX employers shocking behavior

After some advise, i know someone who is taking their ex employer to a tribunal tonight she was telling me that her ex employer has called a company that she may have been starting with to inform them of her being a trouble maker!

To me this is out of order, she has not got to the interview stage yet(so has not provided references) but now feels it's a waste of time as she feels this call has ended any chance of her getting the job.

Is this acceptable for the former employer to do considering the tribunal is on going. Part of the problem with the tribunal was their bullying and intimidation. I said she should tell her lawyer but she thinks it may be within their rights for them to inform future employers of her past.

What do you think.
Anyone ever dealt with this sort of thing before.

  • It depends on the wording

    If they simply called to inform the new employer that they were being taken to a tribunial by her its maybe not very nice but not illegal.

    How do they know about the new company anyway?

    I sued my employer via tribunal, but from what you have said is slanderous, as the ex-company took it on its own back to ring. She def needs to tell her lawyer asap, as its a major issue. The 1st question the lawyer may well ask can this be proved, (not that I'm disputing your friend), but you need as much evidence as possible.

    Sorry to ask, may seem odd, (but theres method in my madness), obviously without asking to many details, did ur friend resign or was she dismissed.

    The reason being -

    If your friend resigned - she has to give her evidence first
    if she was sacked - the employer has to give their evidence.

    no idea how they found out she hasn't exactly shouted about it but it's not been a secret either.

    When they called luckily it was answered by someone who knew her and knew about the tribunal so refused to discuss anything. it was only because the telephone number was displayed that they knew who was calling.

    Will need to ask exact wording and post at a later date(Sun was out and screaming kids playing made the conversation difficult)

    Thats a good sign that it was someone who knew her, and recognised the number, as it may be that ur lawyer will want to ask for a statement,

    I will say one thing, shes got a good friend in you, and tribunals are exauhasting, not phyiscally, but mentally, and she may need a shoulder. x
