Lisyloo, I don't think this is correct. On death, all assets & debts fall into the estate. The executors will then be responsible for meeting the debts using the assets.
I'm a bit confused.
A while ago a colleague committed suicide. He had more debts than assets.
My employer owed his pay to the estate however they never paid it because no-one "took over" or "inherited" the estate.
The claimed they had no obligation to pay the money to estate unless anyone was "inheriting" it.
Were they right? or did they just get away with it?
To my knowledge they never paid it.0 -

A solicitor for the family did ask for the money and they claimed that they were not obliged to pay it.
As far as I know the family/solicitor took no further action, but I was only over hearing phone calls.
I knew my employer quite well and I believe they thought they were acting within the law.
I know them personally so I know they wouldn't have done anything wrong deliberately although they could have been mis-informed or wrong.0 -

Oh I see,I believe they were wrong then as the money would of been paid to the individual,I suspect the solicitor didn't persue if the amount would of been far less than the costs to recover0
