Council tax - single occupancy discount

I am in the process of buying a property in the North of England which is to be my main residence. I currently live in London with my mother in the family home which is owned jointly by my mother and myself.

I am planning to live mainly in my new home but will also need to spend some time in London for work. As my mother has rheumatoid arthritis she is likely to live with me in whichever house I need to be at any time.

Does anyone have any idea whether we should be entitled to the 25% discount on either home - I will consider my new property as my main residence whereas my mother will probably consider the family home to be hers. As there is no way we can both be considered to have both homes as our main residence surely we must be entitled to the discount on one if not both?

    It would appear from what you have stated that your 'sole or main residence' would the property in the north therefore you would be entitled to a single person discount on that property if you are the only occupier.

    As you would no longer be resident for Council Tax purposes at the property in London then providing that your mother keeps this as her main residence and providing that she would be the only resident for council tax purposes then she would also be entitled to a single person discount.

    The assumption on this is that the house in the north is the residence that you would mainly live at and return to and the property in London would be the one which your mother would class as her main home and generally live in and intend to return to if she spend periods elsewhere.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
