House Selling

We live in a small development. The developer/builder is sefusing to finish off the roads and drains making it difficult to sell our house. Our solicitor maintains that no lender will grant a mortgage on an unadopted drainage system is this correct. The developer has already put several of his companies into admonistration and although our contract states that he will make up the roads and drains he wont so where do we go from here. We are forced to sell as my husband is out of work and need to downsize. We do not have a mortgage.

    I assume that you were able to obtain a mortgage to purchase the property?

    Is the entire developement complete?

    I got a mortgage on a house in a cul de sac with unadopted roads, the building society held back £500 of the advance until the roads where adopted, I'm led to believe that this was somewhat unusual from my neighbours that I have spoken to about it, none of them had any trouble.The roads on a new build development are not adopted until the builder has finished building so I guess lending on developments with unadopted roads will not be a problem for most lenders

    We did not have a mortgage and I am not worried about the roads its the Drainage system that concerns us and our solicitor. The development is complete and now belongs to the bank who funded it but they arent prepared to fund the drainage system despite the fact that they arent selling the remaining houses because of the same problem

    We have similar problems with our road and drains after our builder when bust. Unfortunately it's a long and drawn out process which we are still going through 2 years later.

    Contact the builders solicitors who were used to sell the house- it is common practice for them retain £500 per household to finish off the infrastructure.

    Again in order to grant planning permission a bond will be left with the council for completion of the roads and drains. Wise to contact them next

    If the council fails to have got a bond or any form of contract (like in my situation) then you have a right to ask why not. If no reasonable answer can be given then they have failed with thier duty of care and are therefore potentailly liable for all or part of the costs to put it right.
