Advice on Going Bankrupt

On debt management and CCJ's, paying about £300 a month.
Had really bad gambling problem and had bad relapse today. Just need to clear up a few things, and any advice would be appreciated.
1) My bank account is empty, and I understand I have to show bank statements. A lot has gone on gambling and paying back debts to parents and friends. Is this acceptable to pay parents and friends back, and do I have to show proof of this? How will the gambling effect me. I am seeing a
Councillor through Gamcare at the moment and have also phoned up National Debt line.
2) I'm a supply teacher and not much work right now. Will have to sign on over the holidays. Will I be able to waive my court fee? Also when I work, my wages fluctuate from week to week, so was wondering how they work out how much I have to pay.

1) - the OR may look closely into the paying back of friends and family, as it may be classed as a preference payment. The can try and obtain the money back from that (that's if they still have it). It's good that you're attending gamcare, as it shows that you're dealing with your problems. Your gambling may lead to a BRO/BRU, but the gamcare should reduce the length of this.
2) They'll base on an average.

If you look at the stickies on page one of this forum there is a link to the forms and also guidance on court fees and if you can get them waivered. It depends on what you are getting as to how much evidence you need to provide the court for the remission.
For example, we are on income based JSA so only had to provide proof of that in the form of a letter dated in the last month. However, if you are contribution based JSA or are claiming under any other benefit, you need to provide a whole lot more information.
If you don't have the required proof when you go to court, you pay the full fee and then can claim back the court fee afterwards for a refund.Officially BR at 2.10pm on 6th May 2009, ED 7th December 2009

Hi and welcome Gold dust, just to re-iterate JCS's advice about the debt charities. If the court finds you haven't taken professional advice they may delay your BR until you have. Links and no.s in my sig. Also have a good read of the Bankruptcy Help sticky. Lots of good info in the first post including BRO/U'sBSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0
