Have IVA & want to go BR, pls help!?!?

I have been reading through the forum and Im hoping that someone can help me.

I started my IVA in June 08 and have now defaulted on the the past 3 payments. July will be my 4th. I have just received a request from my IP for the past twelve months income and changes in outgoings. They have not contacted me about my missed payments???

I contacted CCCS on Wed via email and they cannot advise me until I get a discharge notice from my IP & my IP are the only ones who can advise me.

I want to go bankrupt as I have got further in debt whilst paying the IVA and from what I have read on the forum, discharge notices are hard to get??

Can anyone tell me how I can get my IP to do this please. Got to be honest I feel scared and my health has really suffered this year so I would really appreciate any advise. Thank you

    Hi Kate, welcome to the forum.

    Before you go any further, give your local County Court a call and ask the bankruptcy clerk if you actually need a certificate, not all courts require them.

    I have called Coventry CC and they want a letter from my IP that they dont object to me bankruptsy or a notice of discharge.

    How can I get them to do this please?? Thanks

    sounds like what the IP has sent you is looking information for your annual review.

    You really need to speak to you IP and tell them you cannot afford payments and want to go bankrupt. Unfortunelty they are the only ones who can help you.

    Hi Kate,

    We have seen a marked increase in clients with IVA problems over the last few weeks however it is difficult to help / advise you from the limited info you have provided.

    Have you received any advice on the possible implications of bankruptcy?

    You also do not appear to have confirmed whether you have spoken to your IP or not.

    As others have said you should contact your IP first however it is also advisable to contact an Independent agency, have you tried your local CAB.

  • Hi Kitty I have just posted by diary about iva into br. I found it easier not to tell my IP I was going BR and let them end all the IVA on their terms and it will work better for you. They seem to be more sympathetic somehow. I know some do hold out on the required paperwork. We stopped paying our IVA in Jan and it is only now that they have decided to totally fail it and tell the creditors. This will also give you time to get your br money together. Don't worry things will get better.
