CSA have phoned out of the blue.

Asking on behalf of a friend, he has had a phone call out of the blue saying he has to pay 9K as he is in arrears.

He has been paying direct to his ex for the entire time. Also paying for item for both his girls. She has even told the CSA this when they phoned.

Is he still liable, what should he do?

    When did the CSA first get involved - did he get a call ages ago? Did he fill out any forms? Was it agreed to be direct pay? What evidence does he have that he paid his ex?

    He had a form previously, and signed it and said he would pay his ex direct.

    He then got a letter saying no you have to pay us direct.

    Then another letter saying no its fine pay the mother and the amount.

    As far as eviedence just the two of them saying.

    As long as the PWc confirms this then it will be ok for any arrears he owes - it would be up to both of them to contact the agency to confirm this and that they are happy with maintenance direct or if the parent with care wishes to use the agency to set collections of the regular maintenance

    is it more complicated if she is on benefits?

    additionally its 2002 -03 only, at which point he was doing agency work. work for 2 weeks then nothing.

    does this make the a difference?

    Probably - if he didn't pay during that time? If she was on benefits during that time, then the money will be owed to the secretary of state and not the PWC.
