Renting and will OR contact landlord

Hi all

I'm in the process of going BR and have a house that I'm going to give up to move in with my boyfriend into a house he rents.

The rental agreement, bills etc will all be in my boyfriends name but my question is will the OR tell the landlord about my BR even though my name isn't down on any rental contracts etc?

i'm loosing sleep worrying over this.

  • I phoned up my housing !!! to tell her i was going BR and she thanked me for letting her know but said it was not necessary as the rent was not included in the Br It was only non priority debts i was going BR for so she would not have heard about it but i told her.
    She also said that the council were the only ones who were informed automatically from the court.
    If you are in rent arrears and that is down on your BR then they will inform them i gather.

    The OR may contact your landlord to check your staying at the address you listed......but you can ask during interview for them not to (no guarantee though)

    They will ask to see your tenancy agreement to check you are renting the size property you say you are and to check the rent you have put on your form is correct. However, as your name isn't on the tenancy agreement the LL isn't your LL, so they may write to your boyfriend instead for confirmation that you live there.

    Thanks for the replies.

    I really hope they don't contact the landlord as they might decide to kick my boyfriend out.

    Like I say everything will be in his name and he will be willing to show the OR the tenancy agreement.

    I'm off to CAB in the morning and will see if they can offer any guidance on it.

    OR will usually contact landlord to disclaim the lease, as the lease is not iny our name, then they will not do this.

    what did you mean by disclaim the lease? sorry it could be me been a bit stupid :confused:

    It's usually a disclaimer which is sealed by the court to say that the OR has no interest in the lease. As the lease is in your boyfriend's name, then the OR cannot do this, and so they have no reason to contact the landlord.
