Incasso - Paying off a debt

    Incasso took me to court and a CCJ was issued with payments based on my CCCS budget, but Incasso are taking me back to court because they want more money (being paid £110 pm on a loan that originally cost £308 pm). They want £406 pm, despite the fact I don't have that money and couldn't afford £308 pm!!!! My dad offered them F&F at 50% then 60% but they still won't budge - they say 75% plus court fees!!! They unfortunately are not very understanding! I hope you have better luck with them then I've had.

    Wow, they sound like they're a little lacking in compassion and understanding! I wonder if that's what they're like with everyone. Sorry to hear your troubles mollyp.

    Has anyone else out there been taken to court by Incasso?

    I've decided to write to the original loan company to see if they will be reasonable. It's worth a try!

    I've got two questions for anyone out there:

    1) Has anyone gone back to the original loan company and been able to deal with them instead of the DCA? How did it work out?

    2) Has anyone other than mollyp been taken to court by Incasso?

    Finally negotiated 65% full and final with Incasso, but we've only managed to do that with 7 days left before they were due to take me back to court. They became more willing to negotiate as time passed!! Hope you get some luck with them.

    We must be getting near to that stage now. We wrote to the original loan company recently to plead for some leniency, but they're yet to reply.

    The loan was £24k-ish and they've only said they'd accept about 75% of that so far. There was a time we could have afforded it, but things beyond our control have changed.

    I'm glad you're sorted anyway. :o

    I am new to to this site but am out of my mind at the moment. I have a CCJ against my name from Natwest and have been paying of monthly on time for the last 2 years with no problem. Out of the blue i get a letter from INCASSO asking for a full payment of £24,252.05. They are threatning to take legal action if i do not pay in full. I have already got a ccj what else can they do. I am so worried and feel total sick about this all. Please help as i am not sure what to do next

    Hi Brett and welcome

    (not sure I can help loads but some extra info may help those who are more knowledgable about CCJs)

    Did the judgement from the CCJ specify that the debt could be paid in installments? If so have you been making your payments in accordance with the judgement?
    When you say that the incasso letter 'asks' for full payment does it say you must make full payment? Incasso may not know there is a CCJ (they can be useless) but Natwest should not have paid the sold on the debt if you have been making payments on time.
    The only other legal action would be a charging order but they would be highly unlikey to get one granted if you have been paying what was agreed.

    Yes the CCJ that was put in place agreed the monthly installments that i have been paying with no problems or any delays i have made sure its the 1st direct debit out of my account.

    The letter says please send a cheque for the full amount or phone to discuss a revised payment plan. But i am paying the most i can and i am worried that they might now apply for a charging order. I only thought they could do this if you have missed a payment !!
