This is quite common. You may have given an undertaking to use your best endeavours to have his name removed from the mortgage. Until this happens he is probably unable to get a mortgage elsewhere. Have you asked them recently? It sounds like it. Presumably you are happy with the mortgage product you have and are able to continue paying the mortgage? If you got Legal Aid, there may be a stautory charge on the property as well.0

Can't remember the original question to re write it.
There is just me on the title deeds and the charge from the mortgage company.
He has another mortgage so that isn't a problem.

If the value of the property dropped below the amount secured, unlikely since the mortgage was in place 10 years ago, they could chase after both of you for the negative equity.
Possibly he didn't mention it when he applied for his new mortgage...
Eitherway it is a disadvantage to him still being a party to the mortgage but having no interest in the property. If you remortgaged it might be difficult, although given that it was 10 years ago and you have met payments since then, it might not be.0
