was this a BAD thing to do?

Hi,

need some of your lovely peeps advice.

i booked a holiday on my credit card before it became apparent that i would have to apply for sequestration.........we are due to go next month, will this go against me when i have to speak to the AIB?:(

i really was not aware of how bad things were when i booked it on my card as my OH had told me that we would be able to pay it off(but obviously now we cant ):mad:

    The longer the time interval between the booking of the holiday and your sequestration the better , I think it would be a good idea to say that you were very stressed at the time and you felt that you needed a break

    Not sure about in Scotland, but in England, the OR can cancel a holiday and take the deposit back if thought necessary.

    It does vary, a modest holiday is more likely to be allowed than an extravagent one.

    i have to wait for a charge of payment before i can apply for my own seqestration and as i only stopped paying my creditors last month i dont really know how long that will take(my OH only signed his trusted deed 6 weeks ago and we think that it is now protected)

    so i think it will be ok to go on the holiday as i really cant see me getting a charge for payment in the next 4 weeks (i have been advised that it can take up to 2 years although i am hoping that it wont take that long):confused:

    I doubt it will take 2 years. You might even find that Northern Rock will do it, if you don't pay them. Are you yourself applying under LILA rules or full sequestration ?

    I am applying for my own sequestration as i don't qualify for Lila

    there are so many differences from sequestration in scotland and bankrupcy in england its difficult to know what to do..............:mad:

    Hi weewillywinkie, the taxman made my ex br 3 years ago this month it took them 14 months from first missed payment. So yes go on holiday and enjoy it, you may be in for a long wait, :)

    its so good to know that someone else has been through this up north lol-

    i am just so worried as we have a jnt mtg with NR but our house is in neg equity of around 60k and my husbands trusted deed has just become protected:D which is a major relief.

    i have no income of my own(3 small children cost to much for child care)

    so hoping that when i comes to it my OH can buy my BI.

    as a matter of interest do you get a ccj before a charge of payment????

    I didnt but i went down the LILA route
    TBH I dont think ex husband did get any CCJ's but i cant say for sure, it seems such a long time ago now.
    He is actually just being discharged this month as when he went br it was for 3 years not just 1.

    CCJ's aren't part of Scots law. Nor is BI. So if any creditors based in England try to tell you different, just call their bluff ;)

    If your property is in negative equity when you go bankrupt then your trustee would probably accept a nominal sum (say £500) to buy out his interest.

    As for the holiday. You booked it before you knew how bad your finacial situation would become. You are not yet 'apparently insolvent' (if you were, you could apply for bankruptcy). So I'm not sure what grounds the AiB could use to suggest that your holiday should not have been booked... :confused:

    On a more positive note - good news that your OH's trust deed has become protected :T
