Hello,
can anyone please help. me and my wife have both declared ourselves bankrupt but recenly been discharged. the strain of this period has caused us to seperate. Can anything be done to sell my house so me and my family can have a fresh start? the house is solely in my name and the official reciever is control over it. any help will be a greatly appreciated.

If solely owned, you can sell it but the OR will have to countersign any sale documents - you will also need to demonstrate to the OR that it is being sold for market value.
Phone RTLU and have a chat with them in the morning.0 -
You can sell it, but any equity will go to the OR. There will be a restriction lodged against it with the land registry so your solicitor will know to pay the OR, and the land registry should inform the OR too.
Other than that you're free to do with it as you wish, although a courtesy call to your OR might be wise.Accept your past without regret, handle your present with confidence and face your future without fear0 -
You can do what you like with the actual house, but any proceeds may be the property of the OR still. Have you bought the BI (beneficial interest) back yet? If not, then the BI belongs to the OR still, therefore any equity.
You need to discuss with your OR as soon as possible, yours and their position with regards to your property.0 -
Presumably the BI will transfer back are 3 years0
