Ex Husband IVA

Hi Everyone

Well you will have to bare with me, as I m new to this website and it has just taken me 3/4 of an hour to find out how to post my problem.

I will start at the beginning and try to keep it brief. My husband and I seperated just over 3 years ago. When he left we didn't have any loans just the mortgage and no credit card bills. I went out to work and spent the next 3 years working, sta:cry:ying out of debt and paying off the mortgage. A couple of months ago, I started getting letters from Natwest saying I owed them £1300 for his account that used to be a joint account, I rang the bank they said it was still a joint acc, I told them that 2 and a half years ago I took my name off. They say I hadn't so I am liable for this debt. I havent had a cheque book, card or statement for this legnth of time. Well this was bad enough until I contacted my ex and asked what was happening. He said he had gotten into debt and that he was doing IVA as he had found himself in 30,000 pounds worth of debt, basically living a life and having fun, while me the mug was counting every penny. Sadly his name is still on the mortgage, yet he doesn't have a share of the equity as what there is should be mine as he said I could have the house as I have the children, there wasn't much equity in the house when he left and all he has paid is the maintenance for his children. I have looked into having his name taken off the mortgage but they will do a solvency check on his name, if he has an IVA is he classed as solvent or insolvent???????:mad::cry:

    If he has an IVA he is insolvent, and is on the Insolvency Register, sorry.

    Thank you for your help, will save me the solicitors costs. Just hope in five years they don't make me sell up.

    You can check his name on the register, it will give you details of who to contact if you have any problems because of his IVA, and you will be able to check when it's finished.
