    I did not read the whole thread, i was responding to a PM by TF as she could not remember the sections, so just make sure my answer fits the thread, bit busy to check myself DD is playing up and there is hell on here, trying to keep my head down to avoid the crossfire between DD and OH:rolleyes: :p:rotfl:

    No as far as I can see it is a provable debt and should be included in your BR. When you talk to the OR just quote that piece Bat has posted. If he comes back with something else ask him what part of the technicle manual it is in and post back here. Though if it stops you getting an IPA and they are happy to include it in your SoA do you want to?

    Are you talking about Council Tax arrears from previous years, or from this tax year?

    If the arrears are from previous tax years, then my understanding is that they should definitely be included in your bankruptcy.

    If they're from this financial year, then it's a bit more complicated, and everything would depend on how many months your in arrears, and what the council has done about it. That's where the "liability order" and "provable debt" part comes into it.

    In roughly general terms, you could say that you should really pay your council tax for the year to come in April of each year, but the council 'allows' you to pay it in instalments. However, if you miss a couple of payments, you lose the 'right' to pay in instalments, and the council can ask you to pay it all as a lump sum.

    If you've got to that stage, then the current year's CT can be included in the bankruptcy.

    This is one of the cases where the OR seems to be tied by another set of legislation - not BR legislation. At least that's the case in Scotland, and I think it's probably one of the areas where it's the same for the whole of the UK. The legislation on council tax defines when you can and can't pay in instalments. The OR or Trustee (in Scotland) should then work out how that affects the debt in your BR.

    What happened with me re CT is:

    I had about £5k arrears for the last 4-5 years. Plus I hadn't payed anything in the financial year in which i went BR (which was in June).

    All of the arrears up to the date of BR were included in the BR. The Council then issued a bill from the date of BR until the end of that financial year and this was paid in monthly instalments from August to March.

    So in other works all CT upto the date of BR was included in BR and I then paid the normal monthly amount by direct debit.

    i.e you shouldn't have to pay anything.

    I am in Scotland btw.

    I hope that this makes sense.

    april 08 -march 09

    now live at my mums house and contribute £35 a month to her bill, obviously its in her name

    Rang council who said it is included as its a 'proved debt'

    Neither does your OR's office by the sounds of it:confused::rolleyes:

    But if the council are happy its included, i would not worry what the OR says, as the council wont be chasing you for it, but if you can get the council to confirm it in writing, i would to be on the safe side;):D
