help with finance agrement
good morning all
i am really sorry if i put this in the wrong place i have only just joined
in may i purchased a new scooter
i paid a thousand pounds deposit and then the rest on finance
i got the bike then i drove it then it broke down after 30 mins the gearbox had no oil in it so it went in for repair for 3 weeks i wernt happy but i thought teething trouble they replaced the whole gearbox then a few weeks after it was losing power coughing so i took it back for repair yet again they have over filled it with oil and the battery acid was also overfilled so i thought this was not on as the bloke who done the pre delivery inspection should have put gearbox oil in aswell anyways i got it back for 2 days and now the engine revs very low its been back fireing and the engine makes a crushing noise so i am fed up now so i am going to tackle them about getting my money back i just want to know what the best way of going about it i mean can i go on the base of neglect from the person who pdi the bike what ever happens i am going to do everything in my power to get my money back

The motoring board might be a better place for this but you have given the garage enough opportunities to fix the scooter.
You can now probably reject the scooter and they need to replace it with the same model.
Also tell the finance company what you are doing as they are the owner of the scooter overall.I beep for Robins - Beep Beep

thanks for your help i ringing them today to see what they can do to be honest i dont want another bike i just want to get rid of it has not stopped being a pain in the backside since i have got it

I would speak to Consumer Direct, look at https://www.consumerdirect.gov.uk, who will be able to give you advice on rejecting the scooter under the Sale of Goods Act. The scooter must be of merchantable quality and fit for purpose. It would appear to be neither.
If the supplying dealer will not refund the sale and return funds to the finance company, then you must speak to Consumer Direct.
Under section 75 of the Consumer Credit Act, the finance company are also liable for the goods supplied, so it is worth contacting them and explaining your problems as they will take up matters with the supplying dealer also.
You have a lot of rights on your side, but ,must act quickly because if you do not, then you will be deemed to have accpeted the goods and any repairs made.
The key here is to log dates, communicate clearly and accurately and to keep recordsDon't lie, thieve, cheat or steal. The Government do not like the competition.

i have wrote to the finance company with copies of paper work and the people who keep fixing the bike are sending there huge files over to help my case out
