Council Tax Demand

I have been late in payment for my council tax for the last 2 months, about 10 days late each time. Last month, RBS froze my account so I was unable to pay anything out after my wages went in...mortgage/loans/credit cards and council tax just to name a few.

I have received a letter/demand today from Wyre Forest District Council stating that as 2 of my payments have now been received late, and the third one has yet to be made, I have to pay the full outstanding balance by 28th June, otherwise I could be "summonds to attend a magistrates court.......etc". Outstanding balance is £658!

Three weeks ago I did write to them pre-warning of the situation, and stated that on the 29th June I would be paying the missed payment, which would bring me up to date. I have had no reply.

How do I stand on this? I now have a new bank account which my wages will be going into this month and have no problems with making the missed payment.

    Don't know if this helps chuckie but i had the same problem last month. I ended up phoning them last tuesday and literally begging them to allow catch up of payments over the next month. They accepted this but only because it was to be repaid over a month and no longer and also they made it a condition that i set up a new dd.
    I think with ct, if you can definately make it clear you are going to pay it then they will accept but councils can be harsh.

    I've had this as well Chuckie (pre-BR) the cut-off point always seems to be about the 22nd of the month? I pay my CT online so when I received the 'pay all now demand' (after a couple of months of late payments) I simply went ahead & made an online payment anyhow - it was accepted & I didn't hear anything else :confused:
    If you don't pay online maybe it would be worth a phone call?

    Well if you can pay the outstanding amount to get you up to date then I would just go in to your local CT office and make the payment asap - if they refuse to accept it then get a note of the refusal in writing.

    That way if they do go to court then you can show that you have tried to pay.

    I am pretty sure that if you make immediate steps to pay them the outstanding amount then they will drop the action as it would make no sense for them to continue it.

    Chuckie - you need to negotiate with them. They do have room to manouvre so don't take no for an answer (in the politest way of course). Each council is different but my council used to let you pay the 2 months spread out over the remaining months left in the year. (I had to do this last year) they originally said they couldn't do it but when I said due to circumstance I had done that in the past they relented.

    Also remind them that you sent them a letter warning them your payment would be late. Do you just owe one payment or do you owe 2? Do you pay by direct debit, if so over how many months. I changed mine from 10 months to 11 months.

    Thanks for the advice. 2 of the payments were about 10 days late. I actually only owe 1 payment, which was due on the 2nd June. Final demand letter was sent dated 16th June. Think I'll try paying the missed payment online and see what happens. After all, they can't take what I don't have. Cheers.
