Can someone help me please!

Hi am on a dmp, had some blue forms from a solicitor, court forms, my dmp company said to fill in the expeniture bit and send back to them, and they would return it with my financial statement to the solicitor, I dont know what this is will it mean I have to attend court, and also (I am trying to sell my house) will this show up when the solictor does his searches, I am really stressed as my partner does not know about my debts, this particular one is for 500. Would be really grateful for some advice and guidance, I was physically sick when I opened it, I am so worried. Please advise thankyou.:confused:

    This sounds like your creditor are going to go for a County Court Judgment?

    If you return the paperwork via your DMP provider, they will admit the claim and you will get a CCJ more or less automatically, which will show on your credit record. it will not show on the land register.

    Where is the case to be held is the first thing.

    Second, if this is consumer credit, you will have been sent a default letter and a termination letter. You need to find those, scan them, minus personal details, account numbers and barcodes and then send a pm to 10past6, as s/he can tell you if they are legally compliant.

    If they are faulty, you can fight the case and stop them.
    If you've have not made a mistake, you've made nothing
  • As RAS has said, 10past6 is great with these things, PM them and they will be able to help you when they log on.

    I know its hard to see, but there very often are ways out of things, it justs takes a while and some help to find them

    Not sure I can help much but there doesn't seem to be a lot of people around today.
    What do the forms say on them - do they have a title? Do you think they relate to the creditor trying to get a county court judgement against you?
    Does the creditor in question know you are trying to sell your house? Could they be trying to get a charging order?
    Did the solicitor send a letter with them and if so what did it say?

  • I have sent the form of now to dmp it did have a court symbol on it, I did forget to say I rang the solicitor, howard cohen, (they took over the account it was GE Money/ Dorothy Perkins) they said once the forms were returned and they looked at them , I could pay in full or if I was eligble pay off in instalments.

    The claimant has a legal right to pursue you through the courts for the debt if you've breached the T&Cs of the agreement.

    YOU also have a legal right to question the claimant has complied with official legislation prior to the case reaching court, by submitting your court papers to your DMP company, you've given up your legal right as the DMP will NOT become involved in disputed debts, they'll simply acknowledge the claim and submit an up to date I&E.

    At this stage, I suggest you stop the DMP company becoming involved untill your certain the claimant has passed the requirements in bringing this claim, in order to do that, I need to view the default notice and termination letter, if you can scan them and PM me the documents, DON'T POST THEM HERE creditors and there muppets read these forums, the least information they have the better.

    Ha, never, ever, believe anything they say, there not acting in YOUR interests, their acting for someone else.
