Hi,
I have just had a look at the letters,it said "there is a high risk it won't pay out the amount" and it gives me options.
1.contiue as i am
2.increase payments.
3.review my overall mortgage arrangements.
There doesn't seem to be anything about a time limit.
I thought there was a 3 year window.

interesting that there is no mention of time limits and they offer advice such as "continue as you are". Doesn't point to any urgency does it? Anyhow best wait for reply and see how you go, keep us posted

We received a letter from Freinds Provident to say we are time barred.
I am putting together a reply,enclosing copies of the warning letter they sent in 2003 (the only ones we have),also a copy of the article in the Observer about the courts finding against FP,and a copy of when FP were fined £675,000 for mis-handling endowment complaints. I have also asked for a full investigation anyway,as i need the facts to put together a case for the courts.
How do i prove i did not receive the letters they said they sent out in 2000 and 2002 ? they reckon my time ran out in June 2003, funnily enough,the same week as i received the two warning letter from them!
We also have 4 Income Protection policies with FP, i may add a bit about not being very confident about FP decision making process if we ever need to claim.
Anyway,i will send the stuff off and see what happens,but thanks to vinno65 for bits of advice picked up.

We received a letter this morning (about 30 mins ago)to say that FP have upheld the complaint on one of our policies (we had 3),they have offered us £3467.26 ! to say i am pleased is an understatement!
Luckily i hadn't sent off yesterdays letter,so i will make it a little less threatening,and then send it.

Well done, the chap in the Observer article was me. I took FP to court and they lost so maybe they are starting to review their policy on time bars who knows? What about the other 2 policies why have they upheld 1 but not the other 2 are they time barring the other 2? sounds a bit confusing can you post an update?

Hi,
We received a letter on Tuesday to say that we were time barred on 2 of the polices,they said that they sent projection warning letters for these polices in 2000 and 2002 (as you also mentioned),to be honest,i only have letters received in June 2003,but they made NO mention of these,they are time barring us,as we did not take action by 17th June 2003,which co-incedently,is bang in the middle of the two letters we did receive.
I typed up a response and enclosed copies of the letters i have in my possession,i told them that i took action within 6 months of June 2003,by surrendering the endowments,and transferring to a repayment mortgage.
They also enclosed another questionnaire for one of the endowments that we were time barred from ??,i told them that i had asked for it weeks ago,but it had not been sent.
I also enclosed a copy of your recent case.I very nearly enclosed an article about the company being fined £675,000 for miss handling endowment complaints,but i held back.
I also asked why they had not mentioned one of the policies i was complaining about,i had NOT received any warning letter at all about this policy,but i complained anyway,as it was the first one i had ever taken out.
I re-stated that we were risk adverse,and i also asked for a full investigation anyway,as i will need the information if i was to prepare a case for the courts.
Anyway,i did all this on Tuesday,on Thursday morning,i had another letter from them to say my original complaint had been upheld (the policy that they had not mentioned,and had not received any letters about).They said it was upheld because they were not satisfied that the risks were not fully explained to us.
I also made reference to the fact that we have four Income Protection policies still with them (paying in for 10 years so far),and backing up the fact we are risk adverse.I did say that i was worried that FP might find a way of not paying out sometime in the future,so i may reconsider continuing to pay into these polices.
I am very happy at the outcome so far,but i am hoping they upheld the other two complaints also,but they could insist i did receive these letters,and who am i to argue?Sponsored by Tesco Clubcard Points !!0 -
hi Carl even if you did recieve these letters they are the ones FP tried to rely on in court against me. They failed. So if you have the bottle go for it. If they have admitted miss-sale on one of the policies this also would not look to clever either. Stick to your guns and keep at them
