csa payments when you are a student

My partner has been told his csa has been backdated to 2002 eventhough form 2002 - 2007 he was in full time education and the csa told him he was exempt form payments but now they are saying he should have been paying £43 a week and are making us pay off 5 years of backdating off in 9 months which is a lot of money for us and they are takign it straight from his wages. Just wondering if anybody knows if they are allowed to do this when he was in full time education? I am posting them proof of his education in hope they will reassess the case.

Probably, the most important thing is, does he have this exemption from payments in writing from the CSA?
If he does, & can prove he was in full time education & not earning anything at the same time, then he should be ok to put up a strong defence as to why he should not be paying these arrears.
I believe those in further education are allowed to work a certain number of hours or earn a certain amount before they become liable for child maintenance via the CSA. I am NOT 100% certain about this though & perhaps someone with more knowledge about this will advise you better.
If he does not have it in writing from the CSA that he was exempt from payments for that period, then this may be more difficult to fight.Donedoingdebt Lightbulb moment January 2000. Debt at highest approx £102,000. Debt now (October 2009 - absolutely fork all!!!):beer:

i spoke to the csa and as long as i have proof of him being a full time student we've been told all the arrears will be wiped off our account so lets hope they stick to their word.0
