Only on a point of law, ie that the chairperson misinterpreted the law and applied it incorrectly.

Just seems odd that the chairperson is only deemed as misinterpreting and misapplication when it does not suit the requirments of the PWC :o

    Creating war??? Calm down!!!

As I said before you have got my post all wrong.

I asked before and will ask again, what part of your post have I misinterpeted?
It is not a question to trip you up, I am aware of the struggles of solo parenting, however please understand that I cannot be in favour of milking the NRP as if HE is an endless pit of money. You know what he spent on the children when you were together, he has to keep a roof over his head and naturally he cannot pay endless amounts of child support whether he has a live in partner or not. Similar to why you deem it not necessary to work more than 16hrs per week.
Just curious as to which part I have got wrong in your post?

The OP is hardly milking the OP if she gets only £6.10 per week. The PWC still has to pay for ongoing costs of the children - even if there was an overpayment £35 per week still doesn't cover half the costs, yet the PWC has to pick up the bill for the past and present. The NRP is the one milking it - by not declaring their true situation, they are ensuring that they contribute the bare minimum towards children they helped to create.

To the OP, ask the CSA for a new assessment, or you have a choice to ask for them to close the case, wait for 13 weeks and then reclaim whereby you will get a % of the NRP wages with no housing costs taken into account. If you PM me with your last assessment details I will advise further.

I get fed up with PWCs being slated for trying to do their best to bring up children with little or no help from NRPs who want to move on with no backwards glance. It is tough financially, but that difficulty should not just fall on PWCs. Yes, NRPs should be able to move on to a certain extent, but they should never be allowed to not contribute towards their own children - ever and if it is difficult, well that is the way it is when you have children. Don't have more until you can pay for the ones you have.

CS1 is notorious for dishing out nil assessments - try under CS2 he may have to contribute more fairly then - his partner's details won't matter either.

I think you may be wrong here:p plenty of decisions go against the NRP AND the PWC. Neither of whom usually know the law inside out, hence the application for set aside which is quite often turned down.

What do you contribute to your housing costs? because a lot of readers here are contributing to it and the cost of raising your child too without any begrudgement.
We are all feeling the pinch in one way or another and not all look to the ex to make ends meet, there are other ways and that is the line you should be exploring :T

DUTR - why do you keep saying that the OP is on benefits, I haven't seen any evidence to suggest that this is the case? NOt all PWCs are on benefits or has that not crossed your mind?

I know not all PWCs are on benefits, my last GF was a PWC for 2 children, she got £24 per week of the NRP and not once did she harp on about getting more, even though she more than likely was entitled to apply for more ;)
