Bankcruptcy Worries

More sifting through paper work and I have found the Statutory Demand, so it looks as if the proper procedures were followed. Sorry for posting questions on here before actually sorting the facts!

The CCCS couldn't help us as the petition had already been served. They did give us a number for Community Legal Advice (0845 345 4345) but our combined incomes didn't qualify us for free legal help. Booking a session with CAB on Monday so hopefully they can answer a few questions.

We rang the Co-op yesterday who said they would have no problems opening a bank account for my partner but seeing that the interview with the OR hasn't happened yet then she is not officially bankcrupt and to ring back after the interview. I thought she was bankcrupt?

Ive started to sort out her Direct Debits and transfer them to my account along with her wages.......just thought - if her wages are paid into my account then do I become involved in her BR? And does me living in her house cause any problems along the line?

    Thanks.

The petition should have a date she has to attend court, or has that been and gone and what you have now is her Bankruptcy Order?

Can you scan what you habe and post it here? Or write exactly what is says?

    Hi thanks...

The hearing was on 12 June apparently but I can't find a letter inviting us there. The BR Order on Creditors Petition states that:

"Upon petition of Phoenix Recoveries, a creditor, whch was presented on 27th Feb" and "Upon hearing the Creditors Agent and Debtor not appearing

"And upon reading the evidence - it is ordered that my partner of (address) be adjudged bankcrupt"

dated 12th June 2009 with time.

OK, then yes, she is definitley bankrupt. Check to see if she's on the Insolvency Register yet

I don't know why they said that to you at the Co-op, she can open a cashminder account anytime before or after BR. Infact you can phone them today to open the account.
