Help re CCJ!
Ok. To cut a long story short I have had a CCJ issued against me for £2600.
I dont dispute that some of this money comprises the loan which I had with them but as far as I am concerned it was in dispute at the time the CCJ was entered.
I had fallen into default with them around the time I sent them a letter re my PPI reclaim. That letter was never responded to however, when I went to follow up I was told that that office had now shut and all papers were sent to another office. That office subsequently went on to deal with the default and would not be drawn in re the PPI.
My question is, I want to have the CCJ set aside as a) I do not agree that I owe this money or b) i have no recollection of receiving a claim form from the in order to respond to it.
I realise its my own stupid fault for getting into debt with them in the first place but I am now extremely upset as I have had to declare it at work. I was reassured that it would not be serious, but I am scared and worried now for my job.
Can anyone give any strong pointers as to any persuasive things I can put in my N244 claim to set aside the judgement or am I just wishful thinking??
(Can I please ask to only reply if you have advice...I really don't need to be told what a silly cow I am as I'm already in bits about everything as it is). Thanks :-)

You can appeal to the courts that service was never recieved in the way of the papers and that you didnt have a chance to provide your defence. Inregards to the ppi they would just vary the ccj amount. But you need to have proof that the ppi was disputed rec del letters etc0

I only have a copy of a letter I sent them in August 2008. When I spoke to them over the phone I think the claim letter may have coincided with the royal mail dispute...I cant be sure.
After the judgement letter from the courts...I get another letter showing me that they've charged 4 months collection activity fee charges plus interest amounting to around £78 per month...on top of the opening balance!!
The APR is on this loan was around 38% and they nigh on forced me to take out ppi indicating that I would not get the loan without it. In my desparation at the time I agreed (hindsight eh).
I don't know what to do really but try to pursue this with the court. I am in the wrong yes but they can't be completely in the right here??
So do you think if I stated that the CCJ could ruin my career and my planned future career it would fall on deaf ears??0 -

I have not admitted or denied the claim. But fell into default with it during which time I disputed the PPI only to find out that the office I dealt with had shut and moved to another one.
I dont recall receiving the notice to go to court about it...my guess is it was around the time of the postal disputes...I definitely got the judgement though! I'm going to attempt to set it aside. Thanks for the form.
Also on a separate issue, London Scottish Finance (now in administration) are demanding £8000 from me on a debt that £3,400. The APR is about 50%, the PPI is ridiculous and they're demand via the debt collector is scarey.
Can anyone suggest anything on what to do?
