    Have you contacted CCCS or National debt line? If not you really need to do it now as they can help you with this. You can ask a CCCS counsellor on here if you wish to but don't leave this any longer. Hard not to do but try not to worry and good luck.

    As far as I remember, an application to vary payment of the order does not stop the N39. N39 is to give details of income and expenditure on oath in front of an officer of the court. It can be issued even if you are not in arrears with payment as it is not enforcement, 'just' fact finding. Even an N245 would not stop the requirement for you to give a statement of means on oath.

    HOWEVER just thought of something - were you given something by someone? To get to the stage of committal warrant the other person should prove that you have previously been served with the papers by hand - or it used to be. It may be worth checking with the court that you have been correctly served so far.

    This will only postpone things but it will make things perhaps a little easier on you so that you can perhaps give the statement more when it suits you.
