Old debts versus current

Don't talk about debts over the phone. Refuse to confirm security questions and insist everything be in writing.
If they write stating that you owe a debt, they probably won't go into details about it. Don't send a CCA request at this stage.
There is a template letter on the board you can send stating that you do not acknowledge any debt to them and that it is against the OFT debt collection guidelines to try to pursue for payment if they are not sure the debt belongs to you. In other words, they first need to prove that a debt is owed before you need to pay it.
After this, you might want to try the CCA route if they do come back with something.
For the CCJ - although it does not become statute barred, if they have not pursued you for payment after 6 years, they would need to reapply to the court for permission to enforce the CCJ. There is a small section on the nationaldebtline site about that. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
Dad Gift 6k ¦ Savings & Inv Tst: £2,500
Loan 10k: £0 ¦ Dad 5.5k: £2,270 ¦ LTSB: £0 ¦ RBS: £0 ¦ Virgin £0 ¦ Egg £0
Total Owed: £2,270 (+6k) 11/08/20110 -
Correct me if i'm wrong, but something i learnt from george is that even though a CCJ comes off your credit file after 6yrs, the CCJ can be chased for all ur life. So IMHO ur better off paying any outstanding CCJs.
The rest of debts /defaults become statute barred after 6yrs, which means that even though you owe that money, the DCA can no longer legally pursue you for it.
Hope this helps.0 -
I think it's 12 years they can chase a CCJ, not all your life.Unless I say otherwise 'you' means the general you not you specifically.0
