Mortgage Arrears Fees - Can I reclaim?

Hi there,
I have been charged arrears fees by my mortgage company for the past 6 months (£55 per month) as I was more than 3 months in arrears each month
Do I have grounds to get them back under the bank charges reclaiming case or are mortgage companies seperate?
I thought that as they are a bank they might fall under the current case but I am not sure
Can anyone advise?

some people dont believe me on this but i had a flat buy to let and the mortgage i got behind as the tenant didnt want his rent increased so i was at a loss every month, but thought oh well propert prices increasing (this was over 2 years ago!!!) so im getting my money. anyway got behind as i was saying and i was incurring charges etc and even solicitors costs for court action.
This year because of financial problems ive gone into full scale claiming my money back, and i confronted Birmigham Midhshires about this. Saying I had to sell the flat, let a good tenant go because of financial hardship etc. which their charges only made the problem worse and after 3 letters fully refunded me what i asked for which was £990 including the solicitors costs, charges and even the mortgage exit fee. does anybody believe me or do i try and scan the letter!!0
