can the pwc leave the country to live

this is just something i have been wondering. me and the pwc live fairly close to each other so collecting and dropping of my little un is no problem, but if she decided she wanted to move countries to say australia for instance would the NRP have to lay down and take it, or could something be done to stop the child moving

i expect thet would lie with the perental responsibility? ie if unmarried and child pre 2003 fathers had no automatic PR - nmarried after this time and automatic PR is issued when signing birth cert. I expect you could contest this in a court?? someone more knowledgeable will be along soon no doubts but thats my understanding re PR0 -

WHAT IS A SPECIFIC ISSUE ORDER?
Either parent of the child can make an application to the Court to determine a SPECIFIC ISSUE concerning the child. It can be on any matter related to Parental Responsibility. For example:- Which school the child should attendWHAT IS A PROHIBITED STEPS ORDER?
- Whether the child should receive medical treatment
- How religion should be included in the child’s upbringing
- Whether the parent with care can take the child to live abroad
Either parent can make an application to the court to prevent the other parent taking action, PROHIBITED STEPS, concerned with Parental Responsibility for the child. For example:- Prevent the child associating with someone who has an adverse influencePERMANENT REMOVAL OF THE CHILD TO LIVE ABROAD
- Prevent medical treatment
- Prevent the child being permanently removed from the country
If a parent with care wishes to emigrate their application for leave to remove the child from the Jurisdiction is likely to be met with strong opposition from the non-resident parent, for obvious reasons. Contact between the child and the non-resident parent is bound to be reduced in these circumstances with the consequent impact on the development of the relationship between child and parent.

but what if you take action after the horse has bolted so to speak? what if you can't afford to go to court to raise these orders etc and the PWC doesn't give a forwarding address etc

They can't if the NRP has parental rights, can't even go on a foreign holiday without written consent :eek:0 -
if you have parental rights, then why dontyou get a court order to stop to PWC taking the kids out of the courtry without your permission!! (that is if she hasnt already gone, not quite sure if that is the case from your posts)0

yeah that was what I was getting at.
You have to do x y z and your not allowed to do this that and the other.
pwc should not obstruct access but some do, nrps should pay for their kids but some dont thats just a fact. bank robbery is not allowed but it happens lol:D
will the authorities act if either an nrp or pwc p*sses orf with the kids or assuming all the paperwork is present and correct ie PR is in place and whatever else will authorities just say well child is with mother/father and as far as they are concerned thats an end to it. its all well n good saying go after the child and nick it back but it probably wouldnt be as easy as that.

yeah but how would that stand if she just did it and didnt inform you, she could in theory just disappear
My mate's ex wanted to take their child away on a holiday, they are not on good terms and she had to ask his permission , Im sure if she had her own way she would have just upped and gone. So there must be some legal stuff somewhere that prevents a parent from just going as they please.
Also they both had to sign some court order to agree regular contact both ways , either party fails and they are in contempt of court :eek:0
