The debt is for £700, so not huge
Just to clarify again: the default was added onto my credit report at some point between June 2008 and March 2009. It wasn't on there when I checked in June. However it was on there in March, and they had put that a default had been registered in February 2008 - this is obviously wrong, I don't remember getting any letters as I was dealing with Capquest, and why wasn't it on my file when I checked in June? I think Capquest may have been the ones to add the default as there's a search on my file from them.
I now have a '5' late payment marker on there and Experian says '5 payments late' , which is incorrect as I was paying Capquest prior to the dispute.0 -

Ok, so do you dispute the debt or want to get out of it or are you in a position to pay it off an make offer for one payment?
Can you get a print of the defaults i.e. before, during and after to prove when it was added and removed with the incorrect date?2010 - year of the troll

I'd love to get the late payment marker removed. If I can do that I'm happy to continue paying. At the moment I'm not in a position to settle as I've just finished Uni and haven't found a job yet.
I have copies of my credit reports from June 2008, March 2009 and recently. All show different statuses of the account.0 -

To recap; you were in account in dispute around May 2008 when the account was then passed to a DCA, the DCA agreed a repayment structure and then for some reason they marked you down as 5 payments late.
Then you checked your credit file and found a default dated XX/XX/XXXX for £XXX amount. However, you're still paying Capquest and for some reason they added a default between June 08 and March 09, the default has now actually gone from your report altogether which would have been between March 09 - Present?
You have never missed agreed payments and confused as to why you have a 5 late payment marker present?
One point to note: did you fall 5 months into arrears with Marbles prior to them selling to CapQuest? An account can't just be passed to a DCA - it has to be in arrears, is this related to the 5 payments? What i'm trying to establish is what do capquest have to do with this cos you're paying Marbles and not capquest?
Who registered the default, capquest or marbles and did you ever get a default notice or letter regards to NOA (assignment of sale of debt)?
Please clarify above and fill in the XX's for me please.....2010 - year of the troll

It seems that Capquest credit searched my Equifax in April 2008, so that was when my account was passed to them. However they didn't put a default on there then. When I checked my Experian in June 2008 it wasn't on there. When I checked it in March 2009 it was on there. So the default was added during the time I was definitely paying Capquest.
Yes the default has been removed but this 5 late payment thing is unfair, as I was paying Capquest beforehand.
I must have missed a payment or something for Marbles to pass my debt on, although I think Capquest were only acting on their behalf, as they didn't have a deed of assignment. I certainly didn't get any letters regarding a default or I'd have paid it! It's not a huge amount of money and I've have at least made the minimum payments. I don't remember missing any payments, but I suppose I must have done for Capquest to get involved.
I don't know who registered the default as it doesn't say, but I was definitely paying Capquest every month and the default was added whilst my account was with them.
I have no more involvement with Capquest now, my account is back with Marbles and it is them I am paying each month.0 -

Listen i'll spend some time with this tomorrow. I need to get my head round it all...... im confused, on your CRA it must show the name of who added a default. It cannot be blank or the default is unlawful...... there must be a name in there.
Also, you cannot get defaulted or passed to a dca for one payment, it is usually 4/5/6 payments which do account for the late payment markers. see where i;m coming from? It does add up, but only if you went 5 payments into arrears which does seem to be the case.

By the way, just checked my Equifax and Marbles/Halifax have given me a green 0 for May. So I have a red 5 in April and a green 0 in May. It also now says 'Up to Date' in the account status whereas before it said 'In Arrears'. This is good but the red 5 looks bad :mad:

It seems the parent added the default (halifax) and reason you paid capquest and now back with oc is because they didn't do a NOA (assignment) so the debt remained with oc (halifax cards).
Make sense?
So marbles say you paid 3 lots in one go and it was actually 3 monthly amounts you paid? have you proof of this by way of bank statement/cheques etc? how do you pay? this could get the markers removed in itself.... i'll deal tomorrow but I do need to know any little points like that as they make a major difference to the letter!

I have a printout of payments that Capquest sent me, and all my bank statements that prove I paid Capquest monthly. They all came out of my Barclays account.
According to the printout I paid £57.62 to them at the start of them acting for Marbles/Halifax on 03/05/08, then paid £45 on 30/06/08, then £45 on the 28th/29th of each month up until end of October when I started the dispute process. I made a payment each month, I didn't miss any payments with them.0
