If you can prove you never received one then you might have a case for saying you never expected to pay it.

How can I do that? I don't think I ever received any leaflets from Abbey about the mortgage since taking it up- only the annual mortgage statement. How can I do that?
Do I want it? ......Do I need it? ......What would happen if I don't buy it??????

Most of the lender's cover it by referring to either generic T&Cs or Tariff documents / leaflets.

That maybe the case - but if they don't make you aware of "extra" terms to the mortgage how on earth are people like me when buying the first mortgage ever suppose to know until the end of the period and get stung for it.

Neither my IFA/Mortgage broker or Abbey in April 04 made me aware of extra charges so i will be chanellgeing them to unfair terms.
