Variation Order

For those of you who have read my previous...Payplan did eventually get back to me. I explained to them that my husband and I had applied for variation orders on both debts with Asset Link. They shocked me by saying that Asset Link had agreed to the payments that have been made for over a year now. So now it seems we have wasted £130 (£65 each variation order application).Further more Assett Link are taking us to court for a charging order which if they have accepted the reduced payment then they can't then go for a charging order. I'm so confused Payplan have really annoyed me the woman on the phone told me they never answer correspondence and that is why our letters/email/telephone messages have all been ignored.
We have successfully fought off the charging order to date we have another hearing end of April but the variation hearing is first mid-April. What do I now? I was going to argue for reduced payments in line with our income/expenditure but it seems that that is what is already happening. Also Payplan's information via the web (Justabank) of what they pay Asset Link is different to what they actually pay. Justabank states £38 in fact they pay (and has been accepted) £18. In the variation court papers we put an argument forward to pay what we were told Payplan were paying £38 now it turns out they are paying less! The court is gong to think we are so disorganised when it is really Payplan. How do we approach this?

Word of warning re Justabank we have learnt the hard way that the totals are not necessarily accurate. We thoght our Asset Link debt was reducing but in fact it has been increasing month on month for over a year. What Justabank failed to show was the interest still being added to the debt. It simply showed the debt decreasing based on a starting figure that they got when we first contacted Payplan. They do not update the record to take in to account creditors who refuse to stop interest charges. The woman I spoke with at Payplan said "Do you want us to write and ask them to stop interest" Stupid question? Is my answer going to be anything other than yes?!

    I'm afraid I don't have any experience of your situation so I've not got any useful advice to give, but I just wanted to send you a bit of sympathy because it sounds as if you are struggling at the moment.
