Is it possible to sue the Council through the small claims court?

    Hello Comfy - sorry no-one has replied to your post, but I'm sure you'll get lots of replies if you copy this post and make it into a new thread (click the New Thread button on the top (ish) left.     I'm thinking of suing the council as well.... Here's my story!!!!

    I've been smelling damp for the past couple of days in the spare room in the maisonette I live in. Then last night, water started dripping from the ceiling. I called the council, but as I own the property, there was nothing they could do. The above maisonette is council property and there are people who are not of this country who live there (and they are really nice peeps!!) who didn't realise that their washing machine was leaking until I looked round the back and the hose wasn't attached properly. The council had put in their machine for them, so the council's to blame. :mad:

    Being as I forgot to renew my home insurance (DOH!) :( , I'm going to have to pay for it all myself, but I think I should sue the council.

    Does anyone know how I can go about it???

    i don't think i posted this correct but anyway,
    I'm just after some advise and input.
    a few days ago i was involved in a car accident.
    this occurred because i went trough an intersection.
    i was not aware this was an intersection because there was no signs or road markings, just wondering could i sue over this and how would i go about it?
    any replies would be much appreciated (:

    yes you need to make a claim on the concils building insurance policy.

    TIP: Call the legal department of the council- not housing- confidently say " I need to make a claim on your buildings policy" instead of sounding like you ar enot clear otherwise you will get fobbed all around the council.

    Also if possible, have you taken photos and video- maybe on your mobile? Also have the tenants admittted to the council it was their fault?

    If you were not sure if it were an intersedction, you need to go back and take some phots and even a vidoe - do you have this facility on your mobile phone?

    i would judicially review this descision it would be most unreasonable ..

    its not your fault they did not provide evidence ..

  • Hi, Emmajohn. I can't really offer any advice as to weather or not you can sue the council but I would be very interested if you did and the outcome. I've had a similar experience in the past and thought the same question but never persued it. Best regards and I do hope you do persue it but please let me know the outcome. Cheers. Carl.
