mortgage/seperation - any advise

    1 have a look on the Yorkshire building society about there freshstart deal for people starting out again
    2 Your EX may want a 50/50 split but he may get a 70/30 or even 75/25 split
    YBS take into account tax credits, income and maintence.
    Stay in your home and offer to buy EX out if your mortgage is not huge and you can get a mortgage !

    Thanks - will have a look at that - unfortunatly as i am in scotland it seems the 50/50 split is deemed as the fair way of doing things - unless you have something to bargin with it appears to be a bit of a battle trying to get anything else - legal split is 50/50 - and if it goes to court it seems to be down to how the judge is feeling on the day - there does not seem to be any set formula in scotland. Even when kids are involved and the main carer is on low wage. Well thats what people are telling me and even lawyer cant say how it would go.
    I could have taken over the mortgage as at the time of seperation it was around 19k. however mortgage had been overpaid (due to my husband putting money from sale of shares towards it a year ago) however 6 months after we seperated he called lender got 45k back and used as deposit on his new house (so mortgage now 64k and well outwith my reach) so think i can rule that option out.
